We are equally sad that you feel this way. People and businesses have been impacted in more ways than we will know for some time to come. It’s very unfortunate what we as a community have had to endure with this pandemic. Additionally, I have no record of Mr ******** calling my employee’s about his situation nor any request for discussing the matter he has claimed. ******** decided to write the same review he has submitted to you on both ******** and ****** reviews. So I assumed he turned down my offer to settle his debt. I did offer to reduce what he owed to Shred415 by half, but no response. In that agreement it clearly states his responsibilities. He and his wife had accepted the studio agreement (added below for your reference). Only then did he decide to bring up that relatives had COVID and the points made in his complaint. The following week or two later, after I had called him several times to discuss, he asked me for two months of free membership, I declined stating that we do not give away free months when a account is in default. ******** until after he had defaulted on his agreed payment date. At that time I offered to freeze his account before the account for both he and his wife went into default. This is because my business system makes us aware and so members can change their credit cards without disruption of service. I contacted ***** before he received an automated notice that his credit card was no longer accepted. I granted two FREE months without payment at his request. One month to move into a new home and the second for a family vacation. During the summer months (when COVID first began) ***** requested his account be frozen for two months. Why they chose to not utilize the services of their membership only they can answer. During their membership I have sent several newsletters which serve to remind them that they are members and what all is happening at Shred415. They infrequently used our services for the entire time as members, **** signed up for 8 classes before summer and in that time and cancelled 3 of those times. ******** and his wife joined my fitness studio on 7/14/20, but let their credit card on file lapse on. I’m responding to a complaint issued by ***** ******** towards Shred415. Considering the restrictions you have applied as well as the state of NC guidelines, we should have received a refund Governor Cooper has strict guidelines in place preventing us from attending the gym, and your gym doesn't allow attendance if you have been exposed to others who have tested positive for COVID-19. There is not a gym membership agreement that members should pay when being refused access due to a pandemic being caused by a virus. The gym requires a temperature check and no exposure to COVID for entry. I notified someone on your staff that we were exposed last fall. You not providing a service we paid for would result in a refund correct? This is what Dave was trying to convey about a credit, because we were set to auto pay. I will provide you with email confirmations directly from school notifying us of positive COVID confirmation cases, which can be back dated the last few month-when restrictions would have applied to us attending the gym. You cannot apply charges during periods when you refuse entry due to the restrictions surrounding COVID exposure. In addition ******** is an in-home service utility with no risk to exposing the virus. ******** isn't restricting us from using a service they are charging us for. ![]() ![]() You mentioned ******** as a scenario, but there is a big difference. I am trying to understand how it is appropriate to restrict us from attending, but continuing to charge us. ![]() I am sure you can imagine that in a family of 5 with 3 kids attending school, this has happened quite frequently. Each time someone in our family is notified of new potential COVID-19 exposure, we are restricted from coming to the gym. We are still not allowed to use the gym because we received another notice from my daughters school that a student tested positive for COVID-19 and we just spent a week with her. With CDC instructions, and the gym itself preventing us from attending by potential exposure to COVID-19 we were restricted from attending the gym for a few months time.
